On to the topic at hand…
I'll readily admit that the title 'deacon' has some ambiguity in how it's been used in the midst of the Church. It has been applied to called and ordained pastors, even in Lutheran history. It's also been used to designate laity who serve in ways to help the clergy to devote more time and attention to things specific to the Office of the Ministry. So it is thorny to make a case for who should and shouldn't be called a 'deacon', aside from the fact that clarity and consistency should always be upheld for the sake of Christ's Church.
The more important issue that really needs to be considered is whether the man who serves to preach, teach, and administer the sacraments for the Church is properly serving according to the Office of the Ministry, or is he attempting to do that which he has not been called to do?
To put it another way, are articles 5 and 14 of the Augsburg Confession being upheld, or is the ambiguity of the title 'deacon' being used to obscure the fact that the Confessions are being ignored and rejected? You and I could discuss the semantics of Ephesians 4, etc., but if we claim to be faithfully 'Lutheran', the Confessions make it pretty clear.
